Subject: OPEN LETTER

POSITION STATEMENTTANI HALF CENTURY NATIONAL DAY

Lelahirnya various laws and legal rules that anti-people, such as: Investment Law No. 25 year 2007, the Law Estates No. 18, 2004, the Indonesian Government Regulation Number 40 of 1996 on the Right (HGU), Hak Guna Bangunan (HGB) and the Right to Use of Land and the Law and other regulations reinforces the dominance of capital in the land of Indonesia.

Millions of hectares of land HGU permit issued by the government, HPH, HTI and other permits on the basis of the State Controlling Right. Development of infrastructure to facilitate a variety of means of support. Exploitation was built and other infrastructure developments.

With the birth of regional autonomy. Government daerahpun embrace competing investors. Pengkavlingan people's lands and communities to be perkebunanan and mining, which displaces people's land, and exploitation of marine and other agrarian resources increasingly massive.

Various products such as plantation, teak, rubber, coffee and other forest industry plants more widespread and even forest dominated by the peasantry and the decades can not escape from pengusuran. Similarly, mining and other mineral resources.

To further smooth the course of this capital flow, even to ignore Human Rights. The government is still repressive actions. Still happening arrest, and imprisonment of farmers who fight for their land.
The security forces should be the protector of society, not a business and investor assets guards let alone kill people.

As a result of various anti-Agrarian Reform policies that run the country for the people who obviously was not obtained justice and prosperity, the more lame precisely control the land and other agrarian resources, growing poverty, hunger and unemployment.

Land disputes became more widespread among the people against the estate companies owned by government or private, Perhutani and state institutions such as the TNI. This is compounded by the role of the National Land Agency (BPN), which appears to be merely a rubber stamp of the various anti-agrarian reform policies.

Thousands of hectares of land dispute settlement in Jember between communities with Perhutani, PTPN, the PDP and the TNI as in Ketajek (477.84 ha), Curahnongko (332 Ha), Nogosari (372.5 ha), Karangbaru (91 Ha), Mandigu (395 , 16 Ha), Pondokrejo (357.69 ha), Bulk Takir (196 Ha), Sukorejo (292.07 ha), and cases of other land that is still also still not showing significant growth.

Likewise, the dominance of capital in the agricultural and fisheries production was not lost on them. Monopoly corn and hybrid rice seed and fertilizer distribution unjust progressively increased deterioration of the peasants in the countryside and fishermen at sea.

The birth of the Agrarian Law No. 5 of 1960, since half Abat ago, still not able to answer the question above was impressed even castrated.

But all these forms of injustice, did not dampen the fighting spirit and resistance of the peasants, fishermen and the public. Various forms of resistance began hiring, action, reklaiming, mastery and utilization of agricultural resources, especially land continue to be done.

Reforma Agraia slow settlement in Indonesia, because there are many laws or regulations that are contrary to the spirit of agrarian reform. So the case of existing land, it is difficult to be resolved, And "If this is done for Agrarian Reform will ensure justice and prosperity for the people" (Joyo Winoto).

On the basis of the above description, the Independent Farmers' Union (SEKTI) Jember as an organization with a mass-member organization of the peasants, laborers and fishermen urged the government, both the President, Governors, Regents and Mayors to immediately run the "Agrarian Reform"
